CORCERNING
AMENDMENT TO ARTICLE 12 OF THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE
No. 230/MPP/KEP/7/97
ON GOODS SUBJECT TO THE TRADE IMPORT SYSTEM
AS ALREADY AMENDED BY THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE
No. 406/MPP/KEP/11/1997

THE MINISTER OF INDUSTRY AND TRADE,

Considering :

• a. that within the framework of providing special treatment for personal effects in the form of used motor vehicles of ambassadors of Indonesia completing their terms of office, it is necessary to amend Article 13 of the Decree of the Industry and Trade No. 230/MPP/Kep/7/1997 on goods subject to the import trade system as already amended by the Decree of the Minister of Industry and Trade No. 406/MPP/Kep/11/1997;
• b. that for this purpose it is necessary to issue a decree of the Minister of Industry and Trade to this effect.

In view of :

The Decree of the Industry and Trade No. 230/MPP/Kep/7/1997 on goods subject to the import trade system as already amended by the Decree of the Minister of Industry and Trade No. 406/MPP/Kep/11/1997.

DECIDES:

To stipulate :

THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE CONCERNING AMENDMENT TO ARTICLE 12 OF THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE No. 230/MPP/KEP/7/97 ON GOODS SUBJECT TO THE TRADE IMPORT SYSTEM AS ALREADY AMENDED BY THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE No. 406/MPP/KEP/11/1997.

Article I

To amend Article 13 of the Decree of the Industry and Trade No. 230/MPP/Kep/7/1997 on goods subject to the import trade system as already amended by the Decree of the Minister of Industry and Trade No. 406/MPP/Kep/11/1997, so that it reads as follows:

" Article 13

(1) Excepted from the provisions stipulated in this decree are:

• a. personal effects;
• b. personal effects in the form of motor vehicles owned by ambassadors of the Republic of Indonesia who have completed their terms of office, either in new or used condition;
• c. goods granted by other countries/aid agencies to the government of Indonesia;
• d. goods which are financed with foreign aid to the government of Indonesia;
• e. goods and/or materials entering manufacturing companies in bonded zones (PPDKB) for further processing into manufactures according to industrial licences of the PPDKB;
• f. goods and/or materials entering bonded zones and/or bonded warehouses for piling, storage, placing and or packaging.

(2) Especially for the motor vehicles as personal effects as meant in paragraph (1) point b., they shall only be allowed to be imported once totalling 1 (one) unit by paying import duty, value added tax and sales tax on luxury goods pursuant to the laws in force.

(3) The stipulation as meant in paragraph (1) shall not apply to goods subject to import bans, motor vehicles as personal effects other than those as stipulated in paragraph (1) point b. and waste.

(4) Exceptions to the import trade system as stipulated in this decree can also be granted with the approval of the Director General of International Trade or authorised officials, for the import of goods:

• a. goods for temporary import;
• b. for the purpose of scientific and technological research and development;
• c. for the purpose of grants and other social aid not meant for resale;
• d. as reimports after overseas repair, previously being indeed of import origin;
• e. for samples pursuant to the Decree of the Minister of Finance No. 140/KMK.05/1997;
• f. for the motor vehicles of foreign ambassadors, foreign diplomatic missions and international agencies pursuant to the Decree of the Minister of Trade No. 326/Kp/XI/93."

Article II

This decree shall come into force as from the date of stipulation.

For public cognizance, this decree shall be announced by publishing it in the State Gazette of the Republic of Indonesia.
